Temporary Suspension of USCIS H-1B Premium Processing Beginning September 11, 2018

News Flash: Beginning September 11, 2018 Temporary Suspension of Premium Processing for Most H-1B Cases

On August 28, 2018, US Citizenship and Immigration Services (USCIS) announced that, effective September 11, 2018, the premium processing service for most H-1B petitions will be suspended. It is expected that the suspension will remain in place until February 19, 2019.

The suspension will not apply to:

  • Cap-Exempt Petitions that are filed exclusively at the California Service Center because the employer is cap exempt or because the beneficiary will be employed at a qualifying cap-exempt institution, entity or organization; or
  • Petitions filed by an employer requesting a “continuation of previously approved employment without change with the same employer.”

This suspension only applies to H-1B petitions. It does not apply to other nonimmigrant classifications.
